1. Acceptance of Terms


These Terms of Use (“Terms”) govern your access to and use of the FortifyOps platform located at http://www.fortifyops.ai (“Website”) and the FortifyOps security governance platform and related services (collectively, the “Services”) provided by FortifyOps (“FortifyOps,” “we,” “us,” or “our”).

By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our Services.

 

2. Eligibility and Account Requirements

  • Probe, scan, or test vulnerabilities without written permission
  • Bypass or circumvent security measures or authentication
  • Access data or areas not intended for you
  • Monitor individuals without proper legal authorization and consent
  • Process personal data without appropriate legal basis
  • Violate data protection laws or privacy rights

Misuse Platform Resources:

  • Use automated tools, bots, or scrapers without permission
  • Impose unreasonable load on our infrastructure
  • Interfere with or disrupt the Services or servers
  • Attempt to reverse engineer, decompile, or disassemble the Services
  • Remove, alter, or obscure proprietary notices
  • Use the Services for competitive analysis or benchmarking
  • Resell or redistribute the Services without authorization

Compromise Data Integrity:

  • Upload or transmit viruses, malware, or harmful code
  • Submit false, misleading, or inaccurate information
  • Manipulate or artificially inflate metrics or ratings
  • Delete or alter other users’ content without permission
  • Use the Services to store or transmit inappropriate content

3.3 Monitoring Authorization Requirements

If you configure our Services to monitor organizational systems or communications, you represent and warrant that:

  • You have full legal authority to authorize such monitoring
  • All necessary consents have been obtained from affected individuals
  • Employees and stakeholders have been properly notified
  • Monitoring complies with all applicable laws and regulations
  • You maintain compliance with employment and privacy laws
  • You will immediately notify us if authorization is revoked

4. User Responsibilities

4.1 Compliance Obligations

You are responsible for:

  • Ensuring your use complies with all applicable laws
  • Obtaining necessary licenses, permits, and consents
  • Complying with industry-specific regulations
  • Maintaining appropriate security measures for your account
  • Ensuring authorized users understand and follow these Terms

8.2 No Guarantee

We do not warrant that:

  • The Services will meet all your requirements
  • The Services will be uninterrupted or error-free
  • All security risks will be detected
  • All compliance issues will be identified
  • The Services will prevent all security incidents

8.3 Your Responsibility

You acknowledge that:

  • Security governance requires human judgment and oversight
  • Automated detection has limitations
  • You remain responsible for your security and compliance
  • The Services are tools to assist, not replace, your obligations

9. Limitation of Liability

9.1 Limitation Amount

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF £100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

9.2 Excluded Damages

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL.

9.3 Exceptions

These limitations do not apply to:

  • Death or personal injury caused by negligence
  • Fraud or fraudulent misrepresentation
  • Any liability that cannot be excluded by law

10. Indemnification

You agree to indemnify, defend, and hold harmless FortifyOps and its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including legal fees) arising from:

  • Your violation of these Terms
  • Your violation of any laws or third-party rights
  • Your User Content
  • Your use or misuse of the Services
  • Your breach of data protection obligations
  • Unauthorized monitoring or data processing

11. Dispute Resolution

11.1 Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.

11.2 Informal Resolution

Before initiating formal proceedings, you agree to attempt to resolve disputes informally by contacting us at legal@fortifyops.com.

11.3 Jurisdiction

Any disputes that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of England and Wales.

11.4 Time Limitation

Any claim arising from these Terms or the Services must be brought within one year after the claim arose.

  • Your User Content
  • Your use or misuse of the Services
  • Your breach of data protection obligations
  • Unauthorized monitoring or data processing

12. General Provisions

12.1 Entire Agreement

These Terms, together with our Privacy Policy and any other applicable policies, constitute the entire agreement between you and FortifyOps regarding the Services.

12.2 Amendments

We may modify these Terms at any time. We will notify you of material changes via:

  • Service announcement
  • Website notice

Continued use after changes constitutes acceptance of modified Terms.

12.3 Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall continue in full force and effect.

Our failure to enforce any provision shall not constitute a waiver of that provision or any other provision.

12.5 Assignment

You may not assign or transfer these Terms without our written consent. We may assign our rights to any successor or acquirer.

12.6 Force Majeure

Neither party shall be liable for failures or delays due to circumstances beyond their reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemic, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

12.7 Survival

Provisions that by their nature should survive termination shall survive, including but not limited to intellectual property rights, confidentiality, disclaimers, limitations of liability, and indemnification.
